1. Acceptance of Terms
By accessing or using the Tech Debt Radar platform located at https://debt-radar.arkyvion.com (the “Service”), operated by Arkyvion (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree with any part of these Terms, you must not use the Service.
We reserve the right to update or modify these Terms at any time. Continued use of the Service after such changes constitutes acceptance of the revised Terms. We will notify registered users of material changes via email or an in-app notification.
2. Service Description
Tech Debt Radar is a software-as-a-service (SaaS) platform that performs automated static analysis of source code repositories to identify technical debt, code smells, architectural risks, and maintainability issues. The Service generates metrics, risk scores, and actionable reports.
The Service is provided on an “as is” and “as available” basis. Analysis results, scores, and recommendations are generated algorithmically and should be treated as advisory guidance, not as definitive engineering assessments. You are solely responsible for any decisions made based on the Service’s output.
3. Account Registration & Security
To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your credentials secure. You are responsible for all activity that occurs under your account.
You must notify us immediately at support@arkyvion.com if you suspect unauthorized use of your account.
4. Subscription Plans & Payments
Tech Debt Radar offers both free and paid subscription plans. Paid subscriptions (“Pro”) unlock additional features including historical trend analysis, unlimited scans, and priority support.
All payments, billing, invoicing, and subscription management are processed by Paddle.com Market Limited (“Paddle”), our authorized Merchant of Record. Paddle acts as the reseller of the Service and handles all payment transactions, applicable taxes (including VAT/GST), currency conversion, and payment compliance on our behalf.
By subscribing to a paid plan, you agree to the following:
- Automatic Renewal: Subscriptions automatically renew at the end of each billing cycle (monthly or annual) unless canceled before the renewal date.
- Price Changes: We reserve the right to modify pricing. You will be notified at least 30 days before any price increase takes effect. Continued use after the notice period constitutes acceptance.
- Payment Methods: Paddle supports major credit/debit cards, PayPal, and additional local payment methods depending on your region.
- Paddle’s Terms: Your purchase is additionally subject to Paddle’s Terms of Service and Privacy Policy.
5. Refund Policy

6. Data Handling & Privacy
Your privacy is critically important to us. We do NOT store your source code. Repositories are cloned temporarily into ephemeral containers for analysis and deleted immediately after. We only retain aggregated metrics and scores.

7. Intellectual Property
The Tech Debt Radar platform, including its software, algorithms, user interface, documentation, and branding, is the exclusive intellectual property of Arkyvion and is protected by applicable copyright and intellectual property laws.
Your Code: You retain full ownership of your source code and repositories. The Service does not claim any intellectual property rights over the code you analyze.
Your Reports: Analysis reports, metrics dashboards, and exported data generated by the Service from your repositories belong to you. You are free to use, share, and distribute them without restriction.
You may not reverse-engineer, decompile, or create derivative works of the Service’s proprietary algorithms or software.
8. Acceptable Use
You agree not to:
- Use the Service to analyze repositories you do not own or have explicit authorization to analyze.
- Attempt to overwhelm the Service with excessive API requests, automated scraping, or denial-of-service attacks.
- Circumvent or bypass subscription limitations, access controls, or rate limits.
- Use the Service for any illegal purpose or in violation of any applicable laws or regulations.
Violation of this section may result in immediate account suspension or termination. If your account is terminated for abuse, you may still request a refund in accordance with our Refund Policy.
9. Limitation of Liability
To the maximum extent permitted by applicable law:
THE SERVICE IS PROVIDED “AS IS.” We make no warranties, express or implied, regarding the accuracy, completeness, or reliability of analysis results, risk scores, or recommendations. The Company shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from:
- Decisions made based on the Service’s analysis, metrics, or AI-generated recommendations, including but not limited to production outages, data loss, or performance degradation resulting from refactoring actions.
- Interruptions, delays, or errors in the Service’s availability or functionality.
- Inaccuracies in complexity metrics, risk scores, code smell detection, or any other analytical output.
- Unauthorized access to your account arising from your failure to maintain adequate credential security.
In any event, our total aggregate liability shall not exceed the amount paid by you for the Service during the twelve (12) months preceding the claim.
10. Service Availability & Modifications
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. Planned maintenance windows will be communicated in advance whenever possible.
We may update the Service’s features, algorithms, and scoring methodologies without prior notice to improve accuracy and quality. Such updates may affect historical comparisons of analysis results.
11. Termination
You may terminate your account at any time by contacting support@arkyvion.com. Upon termination:
- Your access to Pro features will continue until the end of the current paid billing period.
- Your analysis data will be retained for 30 days, after which it will be permanently deleted.
- We reserve the right to terminate your account for violation of these Terms, with or without prior notice.
12. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of Guatemala, without regard to its conflict-of-law provisions.
Any disputes arising from or relating to these Terms or the Service shall first be attempted to be resolved through good faith negotiation. If a resolution cannot be reached within 30 days, the dispute shall be submitted to the competent courts of Guatemala City, Guatemala.
